Terms of Service

These terms govern your use of HeadStudio ("the Platform"), operated by HeadStudio (Pty) Ltd ("we," "us," "our"). By placing an order, you agree to these terms.

1. Service Description

HeadStudio is an AI-powered professional photoshoot platform. You upload selfie photographs, and our AI generates professional images including headshots, full-body portraits, and executive scene compositions. The service is delivered digitally - no physical products are shipped.

2. How It Works

• You upload 6-20 selfie photographs via our secure upload page
• Our AI trains a temporary model on your facial features
• The model generates professional images across multiple poses and scenes
• A quality check ensures only professional-grade images are delivered
• You receive an email with a download link (valid for 7 days)

All prices are in South African Rand (ZAR) and include VAT where applicable. International customers may pay in USD via PayPal.

4. Guaranteed Keepers

Each tier guarantees a minimum number of professional-quality images ("keepers"). If our AI quality check produces fewer keepers than guaranteed, we will automatically regenerate images to meet the contracted count. If we cannot meet the guaranteed count after regeneration, you are entitled to a full refund.

5. Image Ownership & Intellectual Property

• You own all generated images. Upon delivery, you receive full, unlimited, commercial rights to every image we generate for you.
• You may use your images for any purpose: LinkedIn, company websites, business cards, marketing materials, publications, or any other commercial or personal use.
• HeadStudio retains no rights to your generated images. We do not use your images in our marketing, gallery, or training data unless you explicitly opt in.
• Your uploaded selfies remain your property at all times and are deleted per our Privacy Policy.

6. AI Disclosure

All images generated by HeadStudio are created using artificial intelligence. While our AI produces photorealistic results, the images are AI-generated and not photographs taken by a camera. You are free to use these images professionally, but we recommend transparency where appropriate (e.g., noting "AI-generated" if required by your industry or platform).

7. Satisfaction Guarantee & Refunds

• 14-day satisfaction guarantee: If you are not satisfied with your images for any reason, contact us within 14 days of delivery for a full refund. No questions asked.
• Refunds are processed to your original payment method within 5 business days.
• You may keep any images you have already downloaded, even after a refund.
• To request a refund, email support@headstudio.pro with your order ID.

8. Acceptable Use

You agree not to:

• Upload images of anyone other than yourself (or individuals who have given you written consent)
• Use the service to create deceptive, fraudulent, or impersonation content
• Upload images containing minors
• Attempt to access other customers' data or interfere with the platform

9. Service Availability

We aim for 99.5% uptime but do not guarantee uninterrupted service. Generation times are estimates (typically ~1 hour) and may vary based on demand. If your order fails due to a system error, we will either re-process your order or issue a full refund.

10. Download Link Expiry

Download links expire 7 days after delivery. You are responsible for downloading your images within this period. After expiry, images are permanently deleted from our servers in compliance with POPIA data minimisation principles. We cannot recover expired images.

11. Privacy

Your privacy is fundamental to our service. Please read our Privacy Policy for full details on data collection, storage, retention, and your rights under POPIA.

12. Limitation of Liability

HeadStudio's total liability for any claim arising from your use of the service is limited to the amount you paid for your order. We are not liable for indirect, consequential, or incidental damages. This does not affect your statutory rights under South African consumer protection law.

13. Governing Law

These terms are governed by the laws of the Republic of South Africa. Any disputes will be resolved in the courts of Gauteng, South Africa.

14. Changes to These Terms

We may update these terms as our service evolves. Material changes will be communicated via email. Continued use of the platform after changes constitutes acceptance.
